Legal paternity testing

Legal paternity testing and what it involves

The process of legal paternity testing may be defined as being a process that is used to determine in a effectively manner the legal paternity of a father towards a child through genetic testing, but mostly through the DNA testing. This can be used to verify and identify the biological connections between them due to the DNA profiles which contain several encrypted sets that reflect the genetic makeup. Laboratories will accept both blood samples as well as buccal swabs as a sample for the paternity testing. Regardless of which the source of the sample is, the test results will be the same since the DNA is the same throughout the human body.

Legal paternity is recognized under the law as being a relationship between a man and a child. Considering this jurisdiction, whenever a case of paternity is put in question, a person may rightfully ask redress from the court by creating a petition through which the paternity of the putative father is determined. After the results are conclusive and the paternity test is confirmed, the court will assign the particular man involved to be deemed for all purposes and intents as being the father of the child. This court decision will usually include support or awards for alimony for the child along with other appropriate rights and the vesting of legal rights towards the child.

Once the paternity of a father is established, and if he wishes to be a part and contribute to the child's growth and education he can fill a parenting plan thorough which he can easily establish his parental rights towards his child. For example, under the law, in the United States, parents are required to file this plan to a district court. Through this particular plan its determined how the biological parents will share their responsibilities on various matters such as physical custody or legal custody which consists in medical insurance and parenting time or visitation.

In order to be acceptable, legal paternity testing through samples of DNA must observe the bond of custody requirement in a strict manner in order to foreclose inconsistencies or issues on irregularities. Also, in order to comply with this requirement, all parents involved in the testing must be properly identified and the samples must be collected by a third person that is not related in any way to any of the parties involved and it is totally objective. It is performed in this manner in order to ensure rulings or awards for inheritance, child support, immigration, social welfare benefits or other adoption purposes. Also, a paternity test can still be reliably performed without the mother, but usually the sample is taken from all the parts involved: the father, the mother and the child.

There are many cases when fathers are insecure when it comes to the child's paternity, this is when the legal paternity testing comes in. It tests the DNA features of both the father and the child in order to establish if they match. Courts of law also vary from state to state, this means that no one can actually guarantee that the results of his DNA test is a qualified evidence unless a witness is available to testify in court.
